MAGMAG Events & Promotion GmbH (hereinafter referred to as MAGMAG) brokers admission tickets (tickets) to end customers on behalf of and for the account of ILLUMINA Lichtergarten GmbH.
MAGMAG is neither the organiser of the events offered, nor does it have any influence on their implementation and execution. Therefore, the contractual relationship with regard to the event is exclusively between the customer (ticket purchaser) and the organiser.

SUBJECT MATTER OF THE CONTRACT
These GTC apply to the sale of admission tickets to visitors to the ILLUMINA event at the Schlosspark Laxenburg location.
When entering or visiting an event, separate general terms and conditions of the organiser or the respective business premises generally apply.

CONCLUSION OF CONTRACT
The purchase of tickets is concluded by MAGMAG sending the tickets electronically by email, which confirms the previously placed online order. The offer for the conclusion of the contract is made by the customer as soon as he has placed his ticket order in the online shop (by clicking on "buy"). By sending the tickets, a contract for attending the booked event is concluded with the respective organiser through the mediation of MAGMAG.

EXCHANGE / RETURN / CANCELLATION OF TICKETS
Since the organiser provides a service for leisure activities and a specific time has been agreed for this, the right of withdrawal in distance selling pursuant to Section 11 FAGG is excluded in accordance with Section 18 (1) (10) FAGG. Cancellation of the purchase contract is therefore not possible. Please check before your purchase whether the date and number of tickets are displayed correctly in the shopping basket. A replacement for tickets not used or only partially used (e.g. due to late arrival) is excluded, as is a replacement for lost tickets.

RETURN OF PURCHASED TICKETS (CANCELLATION)
If an event day of ILLUMINA is closed or cancelled due to bad weather (storm, thunderstorm, etc.), tickets can be rebooked for an alternative date. A refund of the ticket price in the event of a no-show is excluded. Tickets cannot be cancelled due to a postponement by the organiser.

NO EXCHANGE OF TICKETS
Tickets cannot be exchanged. Purchased tickets are valid on the specified day at the specified time.

CHECKING THE CORRECTNESS OF THE TICKET
After purchasing the tickets, the customer is obliged to check that the information printed on them is correct. Complaints must be sent immediately by email to support@magmag.at.

REGULATION IN THE EVENT OF CANCELLATION/CANCELLATION OF THE EVENT FOR REASONS OF FORCE MAJEURE
If the event has to be cancelled due to force majeure, visitors will receive a voucher for an alternative date.

SPECIAL FEATURES OF PRINT@HOME TICKETS / DIGITAL TICKETS
When purchasing tickets via the webshop at www.lichtergarten.at, customers receive their online ticket by email immediately after payment. This ticket can either be printed out or presented in digital form, e.g. on a smartphone, at admission control. The uniqueness and uniqueness of the tickets is ensured by the QR code, which is scanned and checked when entering the event. It is therefore not possible to visit the event multiple times with an identical ticket, as each ticket is immediately validated when scanned at the entrance. The customer is obliged to protect their QR code from duplication by third parties (no publication of ticket numbers and QR codes on the internet).

INSOLVENCY OF THE ORGANISER
Should the organiser file for insolvency, the customer shall have no claim against MAGMAG for reimbursement or compensation of the payment made to the organiser. In this case, the customer must contact the organiser directly.

PAYMENTS
MAGMAG is commissioned by the organiser to process the payment transactions for ticket purchases. MAGMAG has been authorised by the organiser to assert all claims arising from the online purchase against the customer in the name and for the account of the organiser. This includes a system fee charged by MAGMAG, which is included in the ticket price. MAGMAG collects 10% of the shopping basket total from each transaction, which cannot be refunded by the organiser.

SEVERABILITY CLAUSE
The invalidity of individual provisions of these GTC shall not affect the validity of the remaining provisions of these GTC. The invalid clause shall be replaced by a clause that comes closest to the economic and legal purpose of the invalid clause.
